The Court of Appeals also affirmed the $4.3 million arbitration award to Bungie, with an additional $63,210 that must now be paid by Phoenix Digital and all individual defendants. The court noted that the scale of the award is “not completely irrational,” and US District Judge Thomas Zilly ruled that Bungie had provided enough evidence to definitively prove that AimJunkies infringed on the company’s copyrights.
